What happened?
On November 25, 2024, the Colorado Department of Labor and Employment (CDLE) issued a bulletin that includes several updates to the My FAMLI+ Portal, which will take effect on December 10, 2024.

What are the details?
As previously reported by VensureHR on October 31, 2024, update, there have been new additions to the My FAMLI+ Employer Portal and updates for employers, which are as follows:
My FAMLI+ Employer Portal
- Update Employee Count: Starting December 10, 2024, all employers must update their total employee headcount in the My FAMLI+ Employer dashboard, including those with approved private plans. If the count is not updated by the February 20, 2024, due date, the FAMLI Division will assume the employer has ten or more employees.
- Premium Rate Impact:
- Ten or more employees: 0.9% of wages.
- Nine or fewer employees: 0.45% of wages.
- Annual Update: Headcount must be updated annually and will not carry over.
- Premium Rate Impact:
- Private Plan Attestation: Employers with approved private plans must complete their annual attestation in My FAMLI+ Employer to confirm compliance with FAMLI requirements. This task must be completed before accessing other features.
- Annual Summary: After three years, due January 30 each year.

- Employers can also change from a private plan to the Colorado FAMLI plan.

- New Appeals Process: In December, the Department will launch a new platform for filing and managing FAMLI appeals. To use this feature, employers will need to create an account in My FAMLI+ (different from My FAMLI+ Employer).
- The new platform in My FAMLI+ will allow users to file, manage, and track appeals.
- New Tax Withholding Option: Starting in January, FAMLI claimants can withhold 10% of their benefits for federal income tax. This straightforward opt-in or opt-out choice will not affect active claims, but preferences can be updated in the Payments Dashboard in My FAMLI+.
- Withholding: 10% of benefits can be withheld and sent to the IRS.
- Flexibility: future payments can be changed anytime, but this option does not apply retroactively.
