What happened?
On February 25, 2025, the Department of Homeland Security (DHS) announced a new Alien Registration Requirement. Based on President Trump’s January 20, 2025, executive order, this mandate requires all U.S. noncitizens to register to ensure compliance with section 262 of the Immigration and Nationality Act (INA).
Overview:
- Key Points for Employers:
- I-9 Compliance: Expect to see Proof of Alien Registration documents during I-9 verification. Update training materials and protocols accordingly.
- Increased Scrutiny: Noncitizen employees may need time off for biometric appointments, and industries with many noncitizen workers may face higher DHS enforcement and ensure consistent treatment of employees needing time off.
- Avoid Discrimination and Disruptions: Apply uniform verification policies to all workers to avoid liability under anti-discrimination laws.
- Prepare for DHS Audits: Expect increased DHS enforcement and potential audits. Review and ensure compliance with hiring practices and be prepared for audits or raids.
- No Internet Access: No alternate procedure exists for those without Internet access.
- Compliant Workplaces: Employers should ensure they comply with these new requirements to avoid legal complications and potential disruptions in the workplace.
Additional Details:
- Registration Requirements:
- Who Must Register: All noncitizens aged 14 and older who were not registered when applying for a U.S. visa and are staying for 30+ days. Parents/guardians must register children under 14.
- Process: Create a myUSCIS online account, submit fingerprints, and register. DHS will issue evidence of registration, which must be always carried by noncitizens over 18.
- Compliance and Penalties:
- Legal Obligation: All unregistered noncitizens must comply.
- Penalties: Criminal and civil penalties for non-compliance, including fines and misdemeanor prosecution.
