What happened?
On January 28, 2025, U.S. Equal Employment Opportunity Commission (EEOC) Acting Chair Andrea R. Lucas announced a rollback of the EEOC’s Biden-era Gender Ideology policy enforcement. This policy shift aligns with President Donald Trump’s recent executive order on gender.
Overview:
The EEOC’s announcement marks a shift in compliance and enforcement policy regarding sexual harassment and sex-based discrimination. The following are changes already made by the EEOC:
- Removal of the agency’s “pronoun app.”
- Review and removal of forms, posters, and notices to comply with the biological sex policy.
- If an item cannot be immediately removed or revised, a banner has been added to explain why the item is not yet compliant.
The EEOC has not yet rescinded any of its guidance (including the Commission’s Enforcement Guidance on Harassment in the Workplace, the EEOC Strategic Plan 2022-2026, and the EEOC Strategic Enforcement Plan Fiscal Years 2024-2028), but changes are expected.
- The DOJ has indicated it will no longer defend the guidance in court, reflecting a shift in position due to the executive order.
