What happened?
On August 20, 2025, the Ninth Circuit Court of Appeals blocked a district court order that had postponed the termination of Temporary Protected Status (TPS) for Nepal, Honduras, and Nicaragua. As a result, Nepal’s TPS designation expired on August 5, and Honduras and Nicaragua are set to expire on September 8, unless further court action is taken. However, Employment Authorization Documents are valid until November 18th, 2025.
Overview:
On July 31, 2025, a district court postponed the termination of Temporary Protected Status (TPS) for Nepal, Honduras, and Nicaragua until November 18. However, on August 20, the Ninth Circuit Court of Appeals blocked that order, reinstating the original expiration dates for all three countries.
- Nepal’s TPS designation expired on August 5, 2025.
- Honduras and Nicaragua TPS designations are set to expire on September 8, 2025, unless further court action is taken.
Despite these changes, US Citizenship and Immigration Services has confirmed that Employment Authorization Documents (EADs) under categories A12 or C19 remain valid through November 18, 2025. Employers should continue to accept these EADs as valid documentation for work authorization and should not request new documents solely based on TPS expiration. It is highly recommended that employers consult an attorney before taking employment action and determine which supersedes TPS or EAD.

- Form I-797C (Notice of Action).
- Form I-766 (EAD with category A12 or C19).
Employers can monitor updates from USCIS and DHS, as litigation continues in National TPS Alliance et al. v. Noem et al., 25-4901 (9th Cir.).

Temporary Protected Status (TPS) is an immigration status for people from countries facing adverse conditions such war, disaster, or unsafe conditions (8 U.S. Code § 1254a – Temporary protected status).
- It prevents deportation and allows recipients to work legally in the U.S. through an Employment Authorization Document (EAD).
- Does not lead to permanent residency, and when it ends, work authorization and protection expire.
