We wanted to remind employers that, on January 6, 2025, the U.S. Citizenship and Immigration Services (USCIS) disposed of the E-Verify records older than 10 years. Employers should have downloaded and saved these records by January 5, 2025, using the Historic Records Report, which includes essential case details that could be crucial for compliance, especially during audits.
Key Steps Employers should have taken:
- Download the Historic Records Report: Save your E-Verify Historic Records Report.
- Review I-9 Forms: Ensure E-Verify case verification numbers or case details pages are attached to corresponding I-9 forms.
- Consult Your Vendor: If using an electronic I-9 system, confirm with your vendor that all necessary E-Verify data, including older records, are stored.
For employers enrolled in E-Verify from 2015 onwards, this announcement will not affect them until USCIS is ready to destroy records 10 years old. Pre-2015, employers should have acted to avoid compliance issues.
Employers should plan to download, save, and store the relevant information every year to remain compliant and avoid penalties and headaches.
