What happened?
On December 13, 2024, the U.S. Citizenship and Immigration Services (USCIS) published a final rule to permanently increase the automatic extension period for certain expiring employment authorization and/or Form I-766 Employment Authorization Documents (EADs) to up to 540 days.
Overview:
USCIS made a temporary rule permanent, increasing the automatic extension period for certain Employment Authorization Documents (EADs) to 540 days, effective January 13, 2025. This change addresses processing delays and provides more stability for individuals awaiting EAD renewals.
- This benefits employers by reducing administrative challenges and ensuring employment continuity for noncitizen employees awaiting EAD renewals, applying to timely filed renewal applications pending or filed on or after May 4, 2022.
Additional Details:
- Acceptance of EADs: Agencies should accept EADs, including those that appear expired, if the EAD “Card Expires” date has passed and states an eligible category listed on the Automatic EAD Extension page, and the applicant presents a Form I-797C, Notice of Action, receipt notice for a renewal Form I-765, stating the same eligibility category as the EAD.
- Special Instructions for TPS Applicants and Nonimmigrant Spouses:
- TPS Applicants: The EAD category codes on the EAD and I-797 do not need to match if one is A12 (TPS approved) and the other is C19 (TPS pending).
- Nonimmigrant Dependent Spouses: EAD category codes C26, A17, and A18 require an unexpired Form I-94 indicating H-4 (C26), E (A17), and L-2 (A18) nonimmigrant status, presented along with Form I-797C.
- Benefits of the Final Rule: › Longer Automatic Extension Period: Eligible applicants receive an additional 540 days of work authorization while waiting for their renewal EAD applications to process.
- Retroactive Application: Applies to timely filed EAD renewal applications pending or filed on or after May 4, 2022.
- Simplified Verification: Expired EADs are valid when combined with a Form I-797C renewal receipt, provided other extension requirements are met.
- Simplified Employer Compliance: Employers can confirm eligibility using DHS’s Automatic Extension Eligibility Calculator, reducing administrative challenges.
- SAVE Verification: SAVE can verify employment authorization using automatically extended EADs. Additional manual verification may be required if the applicant’s information does not match federal immigration records. Submit a new SAVE verification request if needed.
