Nevada Balances Service and Employment: New Leave Protections for Civil Air Patrol Volunteers

What happened?

On May 27, 2025, the Nevada Legislature passed Assembly Bill (AB) 422, which strengthens job protections for employees who volunteer with the Nevada Wing of the Civil Air Patrol (CAP). It has just been approved by the governor on May 30, 2025.


Overview:

The Nevada Wing of the Civil Air Patrol (CAP) is a nonprofit that supports emergency services like search and rescue and disaster response.


Why It Matters for Employers

  • Increased Leave: Up to 40 days per year of protected leave may now be taken by CAP volunteers.
  • Job Security Obligations: Employers must maintain the employee’s position and benefits during leave.
  • Compliance Required: Failure to comply can lead to lawsuits and financial penalties.
  • Less Scheduling Control: Employers lose the ability to restrict CAP participation during work hours.

Protected Leave

CAP volunteers are now entitled to:

  • 10 workdays per year for training.
  • 30 workdays per year for emergency missions.
  • This leave must be granted without loss of job, seniority, accrued leave, or benefits.

Unpaid Leave Option: Employers may treat this leave as unpaid but cannot require employees to use vacation or sick leave first.


Documentation Required

Employees must provide:

  • Certification from an authorized official (e.g., U.S. Air Force or Governor).
  • Verification from CAP confirming the emergency need.

No Work Hour Restrictions: Employers can no longer block employees from participating in CAP activities during work hours if the leave is authorized.


Legal Protections

Employees can sue if their rights are violated and may recover:

  • Lost wages and benefits
  • Attorney’s fees and court costs
