What happened?
On June 3, 2025, Nevada Governor Joe Lombardo signed Assembly Bill 215 into law (Chapter 238), amending the state’s child labor laws to enhance protections for working minors and align state enforcement with federal standards.
Overview:
Work Hour Limits for Minors Under 16
- Weekly work hours are reduced from 48 to 40 hours.
- Applies to most jobs except for motion picture performers and farm work.
Night Work Restrictions for High School Students (Ages 16–18)
- Prohibits work between 11 p.m. and 6 a.m. on nights before school days.
- Applies to students who are:
- Enrolled in high school.
- Not emancipated
- Exemptions apply for lifeguards, arcade workers, performers, and farm workers.
- Schools or juvenile courts may grant additional exemptions.
Posting Requirements
- Employers must display an updated labor law abstract that includes child labor rules.
- The abstract must be accessible via a QR code provided by the Labor Commissioner.
Federal Law Enforcement: Violations of the Fair Labor Standards Act (FLSA) regarding minors are now also considered state violations, subject to Nevada penalties.
Presumption of Employment: A minor’s presence in the workplace during working hours is considered evidence of employment, even if not officially hired.
Penalties for Non-Compliance
- Misdemeanor: Up to 6 months in jail and/or a $1,000 fine.
- Civil penalties may also apply.
