Reminder New York: Minimum Pay Rate for App-Based Delivery Workers Effective Since April 1, 2025

As a reminder for New York employers, as of April 1, 2025, the minimum pay rate for app-based restaurant delivery workers has increased to $21.44 per hour before tips. This final rate includes a base of $19.96 plus a 7.41% inflation adjustment.

  • The increase marks the completion of a phased rollout that began in July 2023, following the passage of Local Law 115 of 2021, which required the city to study and set fair pay standards for delivery workers.
  • Legal challenges from major delivery apps delayed enforcement until courts upheld the city’s authority in September and November 2023.

Prior to the law’s implementation, delivery workers earned an average of just $5.39 per hour before tips. Since enforcement began in December 2023, delivery apps have paid workers an additional $700 million in wages. The new rate helps ensure parity with the state’s minimum wage, accounts for the lack of benefits, and helps cover equipment costs. It will be adjusted annually for inflation.
