As a reminder for employers in Colorado, Regulation 18862 was adopted by the Colorado Department of Labor and Employment on April 29, 2025, and introduces important clarifications to job protection rules under the state’s Paid Family and Medical Leave Insurance (FAMLI) program.
The Changes:
- Continuous Leave: Employees must be employed for at least 180 days before their leave begins to qualify for job protection.
- Intermittent Leave: Job protection begins once the employee reaches their 180th day of employment, even if that occurs during the leave period.
If subjected to FAMLI, review and update the internal leave policies to reflect these changes.
